			<content:encoded><![CDATA[<p>When someone infringes your copyright, you have a limited time to make your claim. This is based on a legal principle called &#8220;statute of limitations.&#8221; Statutes of limitation, in general, are laws that prescribe the time limit to file lawsuits. The deadlines vary by the type of claim and maybe by the state where you live. The purpose of them is to reduce the unfairness of defending actions after a substantial period of time has elapsed. They allow people to go on with their lives, regardless of guilt, after a certain time.</p>
<p>Because copyrights are governed by federal law, there is only one statute of limitations for claims related to them. Copyright infringement claims have a three-year statute of limitations from the &#8220;last act&#8221; of the infringement. What constitutes the last act can vary. For example, if your image is published in a newspaper without your permission, you have three years from the date that the newspaper was distributed to file your claim in court. But if the infringement is continuing, such as when someone is using your image on the web without your consent, then the time to calculate the statute has not started to run. Instead, it would start when your photo is removed from the website. Determining when a statute has started to run can get a bit tricky. It sometimes starts when you have &#8220;constructive&#8221; notice of the infringement, even if you don&#8217;t have actual knowledge of it.</p>
<p>If someone uses your photo without your permission, you may seek legal remedy from that person within three years of the last act of infringement. So don&#8217;t sit on your claim once you have it. Note, however, to pursue any copyright infringement claims in court, you must first register your copyright with the U.S. Copyright Office.</p>

Contract law protects the parties involved when expectations arise from promises, restitution prevents unjust enrichment and compensation for wrong doing, and criminal law punishes crimes that are so severe (like murder, rape, fraud) that society has a direct interest in preventing and dealing with them. Note that many wrongs can result in liability to both the state (as criminal activity and proceedings) and to the victims (as torts).</p>
<p>Tort law serves to protect an individual&#8217;s interest in their bodily security, tangible property, financial resources, or reputation. Interference with one of these interests is usually met by an action for compensation, most usually in the form of unliquidated damages. The law  of torts aims to restore the injured individual to the position they were in before the tort was committed (the expectation or rightful position principle).</p>
<p>In most countries, torts are usually divided into three general categories: intentional torts, negligence and nuisance. Additional categories or subcategories may be recognized in other countries. Some torts are liability torts. This is when the plaintiff may recover by showing only that they suffered an injury, that caused damages, and that the defendant was responsible for causing the damages. There never a need to show the defendant&#8217;s state of mind or that the defendant breached a duty of reasonable care.</p>
<p>Definition of a tort:<br />
In his famous treatise, Handbook of the Law of Torts, William Prosser defined &#8220;tort&#8221; as &#8220;a term applied to a miscellaneous and more or less unconnected group of civil wrongs other than breach of contract for which a court of law will afford a remedy in the form of an action for damages.&#8221;</p>
<p>In a limited range of cases, tort law will tolerate self-help, for example, using reasonable force to remove a trespasser. I addition, in the case of an ongoing tort, or where harm is merely suggested, the courts will sometimes grant an injunction to restrain the ongoing threat of harm.</p>
<p>Purposes of torts:<br />
The law of torts assesses whether a loss that affects one person should or should not be placed upon another person. Some of the consequences of injury or death, such as medical expenses incurred, can be compensated through payment of damages. Damages may also be compensated, for non-pecuniary damages, such as pain.</p>
<p>The law of tort can be confusing to many, but as an informed society member we can be wary of its effects on us personally and the nation as a whole. Legal responsibilities can often become overwhelming individually or personally if proper care is not taken.</p>

			<content:encoded><![CDATA[<p>n the case of Mark Hone v Six Continents Retail Limited (2005), a pub landlord having collapsed due to overwork successfully sued his former employers in the County Court for breach of duty of care. </p>
<p>Mr Hone, the claimant, started working for Bass (now Six Continents) as a pub manager in 1995 and in 1998 was awarded &#8220;Pub Manager of the Year&#8221;. However, in 1999 he started working at The Old Moat House where he found himself working 13 hour days. </p>
<p>He repeatedly complained to his employers that he was overworked but the employers took no action. He had no assistant manager and other staff members, who left, including two chefs and an administrative worker, were never replaced.</p>
<p>Mr Hone, who had refused to sign a clause opting out of EU legislation that limits the number of hours an employee works, began suffering from headaches and insomnia. In May 2000, he collapsed at work suffering from an anxiety disorder. In 2004, Mr Hone sued Bass for breaching the duty of care owed to him as an employee. </p>
<p>The first instance court ( Swansea County Court ) held that:</p>
<p>Bass had not taken reasonable steps to ensure that Mr Hone did not work over 48 hours, which was likely to cause injury to his health, and that resources were available to employ more support staff for him; and <br />
Bass should pay Mr Hone &#163;21,000 in damages. <br />
Six Continents (formerly Bass) appealed this decision to the Court of Appeal who upheld the Swansea County Court&#8217;s judgment.</p>
<p>Comment: This case highlights the importance of not imposing excessive working hours on employees and ensuring that employees have sufficient staff support. </p>

<p>People don&#8217;t buy products or services - they buy solutions to problems. <br />They buy what those products or services will do for them. </p>
<p>People don&#8217;t want you to sell them something. They want you to solve a <br />problem. That&#8217;s why I say - don&#8217;t sell products, solve problems!</p>
<p>&#8220;Solve what?&#8221; you may ask. </p>
<p>For instance, solve their problem of:</p>
<p>- Not having enough money<br />- Looking old <br />- Being overweight<br />- Having dry skin<br />- Not being loved<br />- Or solve their fear of being burgled or mugged</p>
<p>When you think about it, solving these types of problems could mean <br />big profits for you. Once you&#8217;ve identified a problem, the trick then <br />is to find ways to the solve problem easily, painlessly, quickly and cheaply. </p>
<p>And think about this too. People will exchange their hard-earned cash <br />when and where they feel good. When they buy solutions to their problems, <br />what they&#8217;re buying is the expectation of feeling good. It&#8217;s because, they <br />know they&#8217;ve made the right decision. </p>
<p>That&#8217;s all very well, but how does that relate to a product or service you <br />may already be marketing?</p>
<p>Simple! The secret is to turn product (or service) features into <br />problem-solving benefits. That&#8217;s a sure way to increase your sales. </p>
<p>Here are some examples of what I mean:</p>
<p> People don&#8217;t buy airline tickets&#8230;they&#8217;re buying the quickest way <br /> to get from LA to Denver.</p>
<p> People don&#8217;t buy perfume. They&#8217;re buying love and affection. </p>
<p> They don&#8217;t buy ice cream. They&#8217;re buying cool, tasty, indulgence. </p>
<p> They don&#8217;t buy books. They&#8217;re buying information, guidance, help <br /> and entertainment. </p>
<p> And people don&#8217;t buy a business opportunity. They&#8217;re buying an end <br /> to their financial worries.</p>

<p> They don&#8217;t buy insurance. They&#8217;re buying peace of mind.</p>
<p>So, what does all this mean?</p>
<p>It means, listening to your customer to discover their basic problem. <br />It means learning why your customer needs, or wants, your product or service. <br />Get to know their fears, frustrations and desires!</p>
<p>By doing this, you&#8217;ll be on your way to becoming a &#8220;problem solver&#8221;, and <br />your customers will see you as that&#8230; rather than just a pushy sales person. <br />You see, people hate to be sold&#8230;but they love to buy. </p>
<p>So stop selling! Instead, think to yourself &#8220;what does this person really want, <br />and how can I solve their problem?&#8221;</p>
<p>It&#8217;s really very simple. If you can solve a problem for your customer, you&#8217;ll <br />make the sale. And, by doing that, you&#8217;ll be solving your problems too!</p>
